Galveston County has received questions regarding who is required to obtain a Beach Vending Permit. The following information is intended to clarify the requirements under the Texas Natural Resources Code and the Galveston County Beach Vending Regulations.
Who needs a Beach Vending Permit?
Any person or business operating a business establishment on a public beach under the County's Beach Vending Regulations must first obtain a Beach Vending Permit.
Section 61.177 of the Texas Natural Resources Code provides that:
A person who operates any business establishment, on any public beach outside the boundaries of an incorporated city without first obtaining the required county permit is subject to a fine of not less than $10 and not more than $200.
Law enforcement officers, including Game Wardens and Sheriff's Deputies, may issue citations for violations of this law.
Does it matter if customers pay online or at another location?
No.
The location where payment is made does not determine whether a permit is required.
If a business brings equipment, rentals, services, or advertising onto the beach and makes them available for immediate use by the public, that business is operating on the beach and must have a Beach Vending Permit.
Common Examples
The following activities generally require a Beach Vending Permit when conducted on the beach:
- Renting jet skis or other equipment from the beach, even if reservations are made online.
- Delivering and setting up cabana trailers for customers.
- Delivering and setting up glamping tents.
- Operating parasailing or similar recreational activities from the beach.
- Setting up beach chairs, kayaks, umbrellas, or other rental equipment for customers.
- Advertising goods or services for sale or lease on the beach.
What about signs?
Signs that simply provide directions to a business and do not advertise the sale or rental of goods or services generally do not require a Beach Vending Permit.
However, signs placed on the beach that advertise products, rentals, or services available for sale or lease may constitute operating a business establishment on the beach and require a permit.
What happens if someone operates without a permit?
Operating a business on the beach without the required permit may result in:
- A citation issued by law enforcement.
- A fine of $10 to $200 per violation as provided by state law.
- Each day a violation continues may constitute a separate offense under the Texas Natural Resources Code.
Abandoned or Improperly Parked Trailers
Abandoned or improperly parked trailers on the public beach may be subject to removal in the same manner as vehicles or trailers abandoned on a public highway, since Texas law recognizes the public beach as a public highway for these purposes.
